1. AGREEMENT

1.1 These Terms and Conditions (“Terms”) together with the Rental Agreement constitute the entire agreement between Journey Campers and the Hirer.

1.2 By signing the Rental Agreement or paying the deposit or accepting delivery of the Vehicle, the Hirer agrees to be bound by these Terms.

1.3 In the event of inconsistency, the Rental Agreement prevails.

 

2. DEFINITIONS

  • Vehicle means the campervan described in the Rental Agreement including all fixtures, fittings and equipment.

  • Hirer includes all persons named as drivers.

  • Rental Period means the period stated in the Rental Agreement.

  • Liability means the maximum financial responsibility of the Hirer in the event of damage or loss.

 

3. DRIVER WARRANTIES

The Hirer warrants that:

3.1 All drivers:

  • Are aged 21 years or older.

  • Hold a full and valid driver licence.

  • Have not been disqualified from driving in the past 3 years.

  • Must be named on the rental agreement and have their drivers licence and passport photographed.

3.2 The Hirer and any driver will not:

  • Drive under the influence of alcohol or drugs.

  • Permit an unauthorised driver to operate the Vehicle.

  • Use the Vehicle for any unlawful purpose.

  • Overload the Vehicle beyond manufacturer specifications.

Any breach of this clause voids all insurance cover.

 

4. PAYMENT & SECURITY BOND

4.1 A deposit within 48 hours of invoice is required to confirm booking.

4.2 Full payment is required 30 days prior to commencement of the Rental Period.

4.3 A security bond of $500 will be held and will be returned within 21 days of the return date upon no damage or amount owing in relation to the hire.

4.4 Journey Campers may deduct from the bond any amounts owing including:

  • Damage

  • Cleaning

  • Fuel

  • Infringements

  • Administrative fees

4.5 The bond does not limit the Hirer’s total liability.

 

5. CANCELLATION

Cancellation fees apply as follows:

  • More than 30 days prior: Loss of deposit.

  • 7–30 days prior: 50% of total rental.

  • Less than 7 days: 100% of total rental.

  • No refund for unused days due to early return.

Journey Campers may cancel due to force majeure, safety concerns, or unforeseen mechanical unavailability, in which case liability is limited to refund of monies paid.

 

6. USE RESTRICTIONS

The Vehicle must NOT be driven:

  • On Skippers Canyon Road

  • On Ball Hut Road

  • On beaches (including 90 Mile Beach)

  • Through rivers or floodwater

  • On snow or ice unless authorised

  • On any road closed by NZTA or local authority

Due to South Island alpine conditions (e.g., Arthur’s Pass, Lewis Pass, Haast Pass), the Hirer accepts responsibility for weather-related driving decisions.

Breach of this clause voids insurance.

 

7. INSURANCE & LIABILITY

7.1 Standard insurance is included subject to an excess of $3500

7.2 Optional excess reduction packages may reduce Liability.

7.3 The Hirer is fully liable (no limit) where damage results from:

  • Breach of these Terms

  • Driving on restricted roads

  • Driving off road or prolonged gravel driving.

  • Driving under the influence of alcohol or drugs

  • Water submersion

  • Roof or underbody damage

  • Incorrect fuel usage

  • Wilful or reckless damage

7.4 Insurance does not cover:

  • Personal belongings

  • Tyre damage (unless part of accident)

  • Windscreen chips (unless additional excess reduction  purchased)

 

8. ACCIDENTS

In the event of accident, theft or damage, the Hirer must:

  1. Notify Journey Campers immediately.

  2. Notify Police where required.

  3. Obtain third-party details.

  4. Complete a written incident report.

Failure to comply may void insurance.

 

9. BREAKDOWNS & MECHANICAL FAILURE

9.1 Roadside Assistance

Vehicles are covered by 24-hour roadside assistance through NZRA.

9.2 Mechanical Breakdown (Not Hirer’s Fault)

Where the breakdown is due to mechanical failure not caused by misuse:

  • Journey Campers will arrange repairs at its cost.

  • If repairs cannot be completed within a reasonable timeframe (generally 24–48 hours), the Journey Campers may:

    • Provide a replacement vehicle (subject to availability), OR

    • Refund the unused portion of the rental.

Journey Campers liability is strictly limited to the unused rental days.

Journey Campers is NOT liable for:

  • Accommodation costs

  • Alternative transport

  • Missed bookings

  • Ferry costs

  • Consequential or indirect losses

 

9.3 Hirer-Caused Breakdown

The Hirer is responsible for all costs where breakdown is caused by:

  • Running out of fuel

  • Flat battery due to negligence

  • Lost keys

  • Ignoring warning lights

  • Continuing to drive after overheating

  • Incorrect fuel

  • Driving on restricted roads

All towing and recovery costs are payable by the Hirer.

 

10. MAINTENANCE OBLIGATIONS

The Hirer must:

  • Monitor engine temperature.

  • Check oil and coolant levels.

  • Check tyre condition.

  • Secure all fixtures.

  • Report warning lights immediately.

Failure to comply may result in full liability for resulting damage.

 

11. FREEDOM CAMPING & INFRINGEMENTS

The Hirer must comply with:

  • Freedom Camping Act 2011

  • All NZ local authority regulations

All infringement fines are payable by the hirer.

 

12. LIABILITY LIMITATION

To the maximum extent permitted by law:

12.1 Journey Campers excludes all liability for:

  • Loss of enjoyment

  • Travel disruption

  • Indirect or consequential loss

  • Acts of God (including earthquakes)

  • Road closures

  • Weather events

12.2 Nothing in this agreement limits rights under:

  • Consumer Guarantees Act 1993 (where applicable)

  • Fair Trading Act 1986

  • Contract and Commercial Law Act 2017

12.3 Campervans are only able to be provided for personal use.

 

13. RETURNING THE VEHICLE

The hirer must return the vehicle at the agreed time or may be subject to additional charges. Additional charges may also be incurred if the van is not returned in a clean and tidy condition at the conclusion of the hire for example, fuel or LPG not full and grey water and wastewater not emptied and cleaning fees.

 

14. TRAVEL INSURANCE

The Hirer should check their travel insurance policy in relation to rental cover excess and cancellation cover.

 

15. GPS

The campervans have GPS systems installed for insurance purposes.

 

16. TERMINATION OF RENTAL AGREEMENT

Journey Campers reserves the right to terminate the hire if the Hirer is found to be in violation of any terms and conditions. In such cases, Journey Campers may repossess the campervan without refund.

 

13. INDEMNITY

The Hirer indemnifies the Journey Campers against all claims, losses, damages, and costs arising from:

  • Breach of these Terms

  • Use of the Vehicle

  • Third-party property damage

  • Traffic offences

 

14. PRIVACY

Personal information is collected and used in accordance with the Privacy Act 2020 for:

  • Booking administration, Insurance processing and Infringement enforcement

 

15. GOVERNING LAW

This Agreement is governed by the laws of New Zealand. The parties submit to the exclusive jurisdiction of the New Zealand courts.

 

16. SEVERABILITY

If any clause is unenforceable, the remaining clauses remain in full force and effect.
